This California Consumer Privacy Act (“CCPA“) privacy policy (“CCPA Policy“) is part of our Privacy Policy. This CCPA Policy concerns processing personal information of California consumers (as the terms “personal information” and “consumer” are defined in the CCPA) (collectively, “Consumers,” “you,” or “your“) by Giovanni Cosmetics, Inc., (“GCI,” “we,” “us,” or “our”). Any capitalized terms or other terms not defined in this CCPA Policy have the meaning given to them in the Privacy Policy or, if not defined here or in the Privacy Policy, then in the CCPA. In any conflict between this CCPA Policy and the rest of our Privacy Policy, this CCPA Policy controls regarding Consumers in California and their personal information. Right to Know

You may ask us to tell you categories and specific items of personal information about you that we collect, use, disclose and sell, and categories of sources from which we collected personal information, our business/commercial purpose(s) for collecting or selling the information and the categories of third parties who we shared the information with.

Deletion 

You may ask us to delete personal information collected and maintained about you, subject to some exceptions.

Opt Out

You have a right to not be discriminated against for exercising rights under the CCPA. We will not discriminate against you for exercising any of these rights.

Verifying Your Request 

Only you, or a person authorized to act on your behalf, may make a request related to your personal information.  The request must be verifiable before we can fulfill the requestIf the request is made by someone acting on your behalf, that person must also provide us verifiable proof of the authorization, such as a power-of-attorney signed by you and notarized, or a court order, granting such authorization to the person acting on your behalf.

Verifying your request will require you to provide information for us to reasonably verify that you are the person who we collected personal information about, or require you or a person authorized to act on your behalf to provide information for us to reasonably verify that authorization.

What We’ll Do

After we verify the request, we’ll try to do what you or the person authorized to act on your behalf, asked that you have the right to request.  There are some limits. For example, a request to delete information may be denied if it is necessary for us to retain the information under one or more exceptions in CCPA. A record of your deletion request may be kept pursuant to our legal obligations.

We will use the personal information you provided in a verifiable request only to verify your request. We cannot respond to your request or provide you personal information if we cannot sufficiently verify your identity or authority.

We may charge a reasonable fee or refuse to act on a request if the request is excessive, repetitive, or manifestly unfounded.

Your California Privacy Rights under the “Shine the Light” Law 

Pursuant to Section 1798.83 of the California Civil Code (a separate law from the CCPA), California residents have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the prior calendar year, including names and addresses of the third parties, and examples of the types of services or products marketed by those third parties.
